Terms and Conditions (GTC)

1. SCOPE

These General Terms and Conditions (GTC) govern the relationship between Mamba Art – Tugce Polat (hereinafter "Mamba Art") and customers who purchase products via the website www.mambaartdesign.com or at physical events (pop-ups). By placing an order, the customer accepts these terms as an integral part of the contract.

2. CONTRACT FORMATION

A binding contract is established when the customer completes the online checkout process or purchases an item directly at a physical sales point.

3. PRICING AND CURRENCY

• Prices are displayed in CHF or EUR, depending on the customer's selection.

• For deliveries within Switzerland, prices include 8.1% VAT.

• For international deliveries, the prices shown are net. Import VAT and fees of the destination country may apply.

• Mamba Art reserves the right to adjust prices at any time. The price at the time of order placement applies.

4. PAYMENT

Mamba Art accepts PayPal, Credit Cards, and TWINT. Goods remain the property of Mamba Art until full payment has been received.

5. SHIPPING AND DELIVERY

Orders are shipped from Switzerland.

As our products are handmade, slight delays may occur during peak seasons.

International shipments may occasionally be delayed due to customs inspections or local import procedures. Unfortunately, these processes are outside of our control.

Mamba Art cannot be held responsible for delays caused by customs authorities, postal services, or import procedures in the destination country.

Delivery times are therefore estimates and not guaranteed for international shipments.

Once the order has been handed over to the shipping carrier, Mamba Art is no longer able to influence the delivery process.

If a package is lost in transit, we will assist the customer in opening an investigation with the shipping provider.

In case of confirmed loss by the carrier, compensation will follow according to the shipping provider's insurance coverage.

Mamba Art cannot issue refunds or replacements until the carrier has completed the investigation.

If a shipment is returned to Mamba Art due to an incorrect address provided by the customer, failed delivery attempts, or the shipment not being claimed, the customer is responsible for any additional shipping costs required for reshipment.

6. TAXES AND DUTIES (EU ORDERS)

For orders shipped to the European Union (EU), all applicable taxes (including import VAT) are already included in the purchase price at checkout under the IOSS scheme.

This means that no additional customs duties, import taxes, or handling fees are charged upon delivery.

The total amount shown at checkout is the final price to be paid by the customer.

Refusal of Delivery

If a shipment is refused by the customer and returned to Mamba Art, we reserve the right to deduct the following costs from the refund:

• Original shipping costs
• Return shipping costs
• Any additional costs incurred due to the refusal

If the returned package is lost during transit, Mamba Art cannot be held responsible.

7. RETURNS AND WITHDRAWAL

We distinguish between the region of residence of the customer:

• Customers in Switzerland: Unworn items in original packaging can be returned within 14 days. Items purchased with a discount code or during sale events are strictly excluded from returns and refunds.

• Customers in the European Union (EU): In accordance with EU consumer law, customers have a 14-day right of withdrawal from the date of receipt, including for sale items. To exercise the right of withdrawal, customers must notify Mamba Art by email within the withdrawal period.

• Hygiene Exception (Applies to all regions): For hygiene reasons, earrings cannot be returned or exchanged if the protective seal or packaging has been opened.

• Costs: Return shipping costs are the responsibility of the customer, except in cases of incorrect delivery or defective items. 

  If a return shipment incurs customs charges upon arrival in Switzerland, the amount may be deducted from the refund.

  We recommend clearly marking return packages as “Returned Goods” to avoid unnecessary customs fees.

8. DEFECTS AND HANDMADE NATURE

Mamba Art jewelry is handmade. Minor variations from the product photos are a characteristic of artisanal production and do not constitute a defect. Obvious defects must be reported to mamba.art@outlook.com immediately upon receipt.

Jewelry is subject to natural wear over time, particularly gold plating. Exposure to water, perfume, cosmetics, sweat, or chemicals may accelerate this process. Such wear is considered normal and does not constitute a defect.

9. LIABILITY

Mamba Art is not liable for delayed performance due to force majeure, supplier delays, or incorrect addresses provided by the customer. Liability for slight negligence is excluded to the extent permitted by law. This limitation does not apply to damages resulting from injury to life, body, or health.

10. DATA PROTECTION

All personal data is treated confidentially and processed in accordance with the Swiss Federal Act on Data Protection (revDSG) and, where applicable, the EU GDPR.

11. INTELLECTUAL PROPERTY

All designs, images, and texts on this website are protected by copyright and remain the intellectual property of Tugce Polat (Mamba Art). Any use requires prior written consent.

12. SEVERABILITY AND CHANGES

If any part of these GTC is found to be invalid, the remaining provisions remain in full force. Mamba Art reserves the right to amend these GTC at any time.

13. APPLICABLE LAW AND JURISDICTION

These GTC are subject to Swiss Law. The place of jurisdiction is the headquarters of Mamba Art (Aargau, Switzerland), unless mandatory consumer protection laws of the customer's country of residence take precedence.
